Terms of service
Last updated: [date]
Draft for review. This policy has not yet been reviewed by legal counsel and is not in force. Passages in [square brackets] still need to be completed.
These terms are an agreement between you and [Aqualeo Digecom Ltd]. They cover this website, the Friends of School app, and the school sites we host. By using any of them, you accept these terms.
Who these terms are with
Where a school subscribes to Friends of School, the contract for the service is between us and the school, and its terms take precedence over these for anything they cover. These terms still govern your individual use of the app and the sites.
Accounts
You are responsible for keeping your login details to yourself and for what happens under your account. Tell your school, or us, promptly if you think someone else has access.
Committee and staff accounts carry the ability to publish to a whole school. Schools decide who gets them, and can withdraw them at any time.
Acceptable use
When using Friends of School, you agree not to:
- Post anything unlawful, harassing, defamatory, or intended to intimidate another person
- Use class groups or notices to advertise unrelated commercial services
- Share another person's contact details or photographs without their agreement
- Attempt to access another school's data, or probe, scan, or disrupt the service
- Upload malware, or use the service to send unsolicited bulk messages
Moderation
Schools moderate their own communities: a committee can edit or remove content and remove a member from a group. We may also remove content or suspend an account where we reasonably believe these terms have been broken, or where we are required to.
Where we act, we will tell the school what we did and why, unless the law prevents us.
Payments, shop, and marketplace
Payments for clubs, events, and new uniform are taken by [payment processor], subject to their terms. Refunds for a booking or an order are the school's decision, under the refund policy it publishes.
The preloved marketplace is a listing service between parents. The sale is between the buyer and the seller: we are not the seller, we do not inspect items, and we are not party to the transaction. Committees moderate listings but do not warrant them.
Availability
We work to keep the service available and will give notice of planned maintenance where we can, but we do not guarantee uninterrupted access unless a separate service level agreement with the school says so.
Friends of School is not an emergency notification system of record. Schools should keep an independent way to reach parents in an emergency.
Your content, and ours
You keep ownership of what you post. You grant us the licence needed to host, display, and transmit it in order to run the service, and nothing more.
The Friends of School software, brand, and templates remain ours.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, goodwill, or data, and our total liability is limited to [the amount paid for the service in the preceding 12 months].
Changes, and ending
We may change these terms. If a change materially affects you, we will give reasonable notice through the app or by email before it takes effect.
A school may end its subscription under its agreement with us. You may stop using the service at any time and ask your school to close your account.
Governing law
These terms are governed by the laws of [England and Wales], and the courts of [England and Wales] have exclusive jurisdiction, without affecting any mandatory consumer protections you have where you live.
This policy is published in English, Arabic, and Hindi. If the versions differ, the English version applies.
